Starting around 1900 and quite possibly
before, there has been an elephant sitting in the room that everyone
knows is there but either does not care that it is there or has no
idea how to remove it, irregardless of that, it has been around for
well over 100 years and it is this elephant that continues to
undermine ALL the efforts, principles, and ethics for which our once
great country stood upon... but, no more...
This elephant is American Justice...
And while American Justice is the most
appealing justice of all the other countries in the world today and
those countries that may soon be created, it is still not without
huge flaws... these flaws about which I am about to speak are
generally (but not necessarily always) directed towards (which mean
against) minorities, the uneducated, and the poor.
Justice goes against minorities
simply because they are in the minority and everyone knows that a
Democratic Republic is fueled only by what the majority wants,
leaving the minority to be ignored. And, I would speculate that
there is minimal discrimination among the various minorities as
Justice goes against all minorities equally... which is our sacred
birthright.
Just goes against the uneducated
simply because these people just don't know any better in the sense
that they are not aware that justice is working against them...
hence they are uneducated... these uneducated folks are simply moved
along with the legal systems like cattle going to slaughter in order
to feed the greater good which is always in the hands of the
majority... or the wealthy...
Justice goes against the poor
because they do not have the financial means to hire someone who is
wealthy or educated to advise them of their “rights” under
American Democratic Republic Laws and ignorance of the law is always
kept out of their grasp... for obvious reasons as someone typically
has to be the “scapegoat.”
While this all may seem a little harsh
and overly critical of our great country of ours, I am sure we all
have several examples as to how the wealthy go free and the poor go
to jail...
Some of us who are older than the rest
of you'uns remember the Chappaquiddick Incident which
happened in 1969 where Senator Ted Kennedy was driving a car that was
driven off the Chappaquiddick Bridge, killing Mary Jo Kopechne, a
young colleague with whom Kennedy may or may not have been having an
affair... however, Senator Kennedy left the scene of the accident
and later turned himself (actually the next day) and was never
prosecuted or charged with any crime...
Although, we all know that wealth and
power had nothing to do with the dispensing of Justice here....
And, whether we all follow football or
not, we are all aware of the OJ Simpson Trial and the glove that did
not fit... and, the fact that all his multimillion dollar lawyers
had to do was create a “reasonable doubt” in the minds of the
jury...
And, then there is this idea that many
young males and females are incarcerated today because of selling
marijuana when in some States that drug is legal and those residents
are smoking without the slightest fear of going to jail at all; plus,
while the State law legalizes the drug, our Federal Laws still have
it illegal yet no arrests have been made in those States at all...
What type of Justice do you want to
call this one?
Then there is the 19 year old boy who
got mixed up with the wrong crowd and got heavily involved with drugs
and alcohol and one day when this boy was high on both, a friend of
his asked him to drive him to the store so he could rob it. The
young man did and his friend went inside and killed the owner and
tossed the cash register into the back of the truck and the young man
drove off.
In the next couple of days, he
surrendered himself to authorities and was charged with murder even
though he did not pull the trigger. His parents could not afford a
“high priced” lawyer so his naïve court appointed lawyer advised
him to accept a plea deal and plead guilty to murder to avoid a jury
trial and the death penalty, he did.
This young man is still in prison, 24
years later, serving a LIFE sentence because he was a minority,
uneducated, and poor...
White policemen are killing African
American boys (some of which may be innocent as well as guilty) but
that is not the point...... these boys are losing their lives
because the law is being interpreted in such a way that the person's
actions were justified and the use of excessive force was justified
as well.
I also remember reading a story out of
Boston not too many years ago, where an older African American was
arrested outside a home in a well-to-do Boston neighborhood by white
police because he was seen trying to open a window on the side of the
house. Once that put this older African American person in an
interrogation room and started questioning him about his attempted
“breaking and entering” conduct, these white law enforcement
officers discovered that this older African American actually owned
the house (was a Professor at Harvard) and had lost his key...
...and no doubt was more educated, more
powerful, and more wealthy than these while law enforcement officers
were and would ever be... but, he represented a minority... and,
this is the way American Justice is dispensed.
I have no idea personally how any of
these people might feel who have been involved in or with American
justice from the standpoint of being in a minority, uneducated, or
poor but I do know what it is like to be treated by someone in
BUSINESS who thinks that they are better than you because they are
more educated or have a higher position... and, while I know that
is not the same, I still believe it is similar and I do understand
and believe that this crap has got to STOP.
American Justice can no longer afford
to be both blind, deaf, and stupid if it is to do what it was
intended to do and that is treat all people as equal under the law.
